Merchant Processing Overhead Fee: You acknowledge that credit card processors, PayPal, and online payment gateways charge non-refundable transaction fees to the merchant upon checkout completion. In the event of a customer-initiated order cancellation or return due to buyer-responsible reasons (including but not limited to: change of mind, incorrect size selection, wrong style selected), a strict 5% payment processing fee calculated from the transaction total value, along with any applicable return shipping fees (as detailed in our Returns Policy), will be deducted from your final refund to cover these non-recoverable financial overheads.

SECTION 3 - BIOMECHANICAL ASSISTANCE & BUYER LIABILITY FOR SIZING

  1. Educational Purpose of Tools: At Sensori™, we prioritize pediatric foot health and offer unique tools—including our Printable Fit Finder, digital Fit Quiz, and individual checkout size cross-check options (where customers may input foot length and age data)—designed entirely to reduce parenting decision fatigue and assist in sizing estimation.

  2. Sizing Disclaimers & Sole Buyer Liability: All measurements, charts, and automated/manual size recommendations provided by our system or customer care assistants are guidelines only. Because every child’s foot anatomy is physiologically unique (including variances in instep height, foot volume, and toe splay rate), the final selection of the product size remains 100% the exclusive liability and risk of the customer. 3. Dispute Limitations: Ordering an incorrect size does not constitute an operational error, manufacturing defect, or "item not as described" fault on behalf of Sensori™. Returns and exchanges initiated due to fit issues are governed strictly by buyer-responsible standard return protocols, and are subject to the logistical deductions and transaction fee capture outlined in Section 2.

SECTION 4 - PRODUCTS, SERVICES & SENSORI™ ANNUAL MEMBERSHIP SUBSCRIPTION TERMS

  1. We reserve the right to limit the sales of our products or Services to any person, geographic region, or jurisdiction. All descriptions of products or product pricing are subject to change at any time without notice.

  2. Sensori™ Annual Membership ($39/Year Contract): The Sensori™ Annual Membership is an auto-renewing subscription service that grants users automated 10% discounts, waived standard shipping minimum thresholds, and priority logistics.

  3. Membership Cancellation & Financial Clawback Audit: If you request to cancel your active membership during its 1-year validity period, a refund calculation will be performed under a strict retrospective financial audit:

    • The Clawback Calculation: We will calculate the cumulative economic benefits you have extracted during the membership term. This includes the total dollar value saved via the 10% Member Discount across all completed and processing orders, combined with the full retail value of all standard shipping fees waived under your member status.

    • Store Credit Converted Payout: The remaining residual value of the $39 fee after clawing back utilized benefits will be converted into non-expiring Store Credit Balance credited to your account. Under no circumstances will early cancellations be paid out in cash or reverted back to your credit card/PayPal if benefits have already been extracted. If the value of benefits used exceeds $39, the membership account residual value will be zero, and no credit will be issued.

  4. Dispute Protections: All Membership subscription transactions are managed via international gateways and fully governed by standard gateway merchant agreements. Unauthorized dispute submissions (Chargebacks) filed to bypass this cancellation audit will be vigorously contested using your affirmative digital opt-in logs captured during the checkout flow.

SECTION 5 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the contact details provided at the time the order was made. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

SECTION 6 - INTELLECTUAL PROPERTY & DESIGN RIGHTS

All content included on this site, such as text, graphics, logos, button icons, images, digital downloads, data compilations, anatomical shoe designs, proprietary 3D fruit shapes, and brand slogans (including but not limited to: "Move naturally. Grown responsibly.") is the exclusive property of Sensori™ and protected by international copyright, trademark, and trade dress laws. Any unauthorized replication, scraping, or commercial exploitation of our designs or web copy will result in immediate legal escalation.

SECTION 7 - PEDIATRIC WELLNESS & ACCURACY POLICY

While Sensori™ footwear is anatomically designed to align with natural foot development and biomechanical freedom, the information provided on this website, help center, or by our support team is intended for general consumer educational purposes only. It does not constitute, and should not substitute for, professional medical advice, clinical orthopedic diagnosis, or customized pediatric podiatric correction.

SECTION 8 - PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, or laws; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to submit false or misleading information; (f) to upload or transmit viruses or any other type of malicious code.

SECTION 9 - GOVERNING LAW & DISPUTE RESOLUTION

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located within that jurisdiction.

 

SECTION 10 - TERMINATION AND SEVERABILITY

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service.
